Houston Bankruptcy Litigation

Our firm provides comprehensive guidance for all bankruptcy litigation

When a consumer or business files for bankruptcy, certain protections from creditors take effect to prevent ongoing harassment of the debtor and to provide guidelines for creditors to receive structured and supervised repayments of certain debts.  However, sometimes creditors object to the terms of a bankruptcy plan.

In such a case, the creditors may appeal or litigate the bankruptcy, which requires an experienced bankruptcy litigation attorney.  The debtor also needs legal representation to ensure that the plan is upheld so that debts can be discharged.  Our firm has represented many clients in cases of Houston bankruptcy litigation and can serve you well in this process.

Katy bankruptcy litigation

Our experienced trial attorneys have represented both debtors and creditors in a wide variety of bankruptcy litigation matters, including disputes over the priority of liens, and disputes over whether a debt is being properly discharged.  We have a thorough knowledge of bankruptcy laws and are able to represent cases on either side of a bankruptcy dispute.

Bankruptcy appeals

Someone who feels that a bankruptcy case was decided incorrectly may file an appeal within 14 days of the judgment.  The case will be heard by a bankruptcy judge, who will rule on the validity of the bankruptcy and its terms.  We have experience representing both creditors and debtors in all kinds of bankruptcy litigation in Houston and Katy, including appellate cases.  We have successfully handled bankruptcy appeals in the Federal District Courts and the 5th Circuit Court of Appeals.

We know the law

Because bankruptcy cases are filed in United States Bankruptcy Court, federal law governs bankruptcy case procedures.  However, state laws are often applied in determining property rights in a bankruptcy case.  For example, law governing the validity of liens or rules protecting certain property from creditors derive from state law.  For that reason, state law plays a significant role in many bankruptcy cases.  Handling bankruptcy litigation and disputes over lien priority and property rights is an area with which our firm has a tremendous amount of experience and knowledge.  Whether you are a creditor or a debtor, we can manage your case effectively and move efficiently toward best possible outcomes.
